Techotlist Connects LLP, a limited liability partnership registered under Indian law ("Company", "we", "us", or "our"), operates Techotlist ("Platform"), a US-focused IT staffing marketplace connecting Bench Sales Marketers, Recruiters, and Jobseekers with vendors and sub-contracting companies for job placements and resume submissions. The Platform is developed and operated in India in compliance with applicable Indian laws and US work authorization regulations.
By accessing or using Techotlist, you ("User") agree to be legally bound by all terms and conditions of this User License Agreement ("Agreement") in their entirety. If you do not agree, you must immediately cease all use of the Platform.
1. Definitions
- Platform: The Techotlist online marketplace, mobile and web applications, and all associated services including job postings, candidate submissions, hotlist management, chat interfaces, and job searching functionalities.
- Techotlist Connects LLP / Company: The legal entity that owns and operates the Techotlist Platform, registered as a Limited Liability Partnership in India.
- User: Any individual or entity accessing or using the Platform, including Bench Sales Marketers, Recruiters, Jobseekers, and corporate account holders.
- Bench Sales Marketer: An individual or company representing candidates and seeking job opportunities for them with vendors, clients, or sub-contractors on the Platform.
- Recruiter: An individual or company posting job openings and searching for candidates via the Platform.
- Jobseeker: An individual seeking employment who submits their resume and personal details on the Platform.
- Company Email ID: An email address issued and owned by a registered business or corporate entity, excluding all personal email accounts on public or free domains including but not limited to Gmail, Yahoo, Hotmail, Outlook.com, Zoho, iCloud, Rediff, and any similar free personal email providers.
- User Data: All data including resumes, job postings, hotlists, messages, personal information, and other content submitted to or generated on the Platform by a User.
- Corporate Account: An account created and authenticated on the Platform using a valid Company Email ID.
- Personal Data: Any data about an individual who is identifiable by or in relation to such data, as defined under the Digital Personal Data Protection Act, 2023 (DPDP Act).
- Data Principal: The individual to whom Personal Data relates, as defined under the DPDP Act, 2023.
- Data Fiduciary: The entity that determines the purpose and means of processing personal data; Techotlist Connects LLP acts as a Data Fiduciary under the DPDP Act.
2. Company Email ID Requirement and Account Authentication
This section is a critical data security and access control mechanism designed to protect the proprietary data and business interests of corporate entities that employ Users on the Platform.
2.1 Mandatory Use of Company Email ID
- Corporate Email Only: All Users must register and log in to the Platform exclusively using a valid Company Email ID issued by their current employing organization. No exceptions are permitted.
- Prohibited Email Domains: The following are strictly prohibited: Gmail, Yahoo, Hotmail, Outlook.com, Zoho, iCloud, Rediff, and any other free personal email services. This list is illustrative and not exhaustive.
- Purpose: This requirement ensures that Platform access and associated data is controlled and authorized by the employing organization, protecting the confidentiality of corporate data, job listings, candidate hotlists, and communications.
2.2 Account Ownership and Employer Association
- Employer-Linked Account: Your Platform account is directly associated with the Company Email ID used to register. All data uploaded, generated, or accessed through your account is associated with the employing organization corresponding to that email domain.
- Non-Transferability: Your account and all associated data are strictly non-transferable. You may not assign, transfer, or carry over your account to another organization or personal use under any circumstances.
- Single Active Account: Each User may hold only one active account at a time. Creating multiple accounts is prohibited and constitutes a material breach of this Agreement.
2.3 Data Handling Upon Change of Employment
- Obligation to Update: If you change your employer, you must immediately cease use of your prior account and create a new account using your new Company Email ID.
- Automatic and Permanent Data Deletion: Upon deactivation or expiration of your prior Company Email ID, the following data will be automatically and permanently deleted: (a) all job postings; (b) all candidate hotlists; (c) all chat messages and message history. This deletion is irreversible.
- Retention of Professional Connections: Professional connections established through the Platform (the Prospects tab and contact network) will be retained and carried over to your new account.
- No Liability for Data Loss: Techotlist Connects LLP bears no liability for any loss of data, business opportunities, or relationships resulting from the mandatory deletion of data associated with a prior Company Email ID.
3. User Eligibility and Representations
- Age Requirement: You represent and warrant that you are at least 18 years of age. The Platform is not intended for use by minors. If we become aware that a person under 18 has created an account, we will immediately terminate it and delete all associated data.
- Legal Capacity: You represent that you have the legal capacity and authority to enter into this Agreement, and where applicable, to bind your employing organization.
- Employer Authorization: If you are a Bench Sales Marketer or Recruiter, you represent and warrant that you have obtained all necessary authorizations from your employing organization and from all candidates whose information you submit to the Platform.
- Accurate Credentials: You represent that the Company Email ID you use to register is a legitimate, active corporate email issued to you by your current employer, and not a personal, shared, or unauthorized account.
4. User Responsibilities
- Accurate Information: Provide accurate, truthful, and complete information when posting resumes, job opportunities, or using any Platform feature. Misrepresentation may result in immediate account suspension and legal liability.
- Compliance with Laws: Abide by all applicable laws including Indian platform laws, US work authorization laws (H1B, OPT, CPT, GC, etc.), the DPDP Act, 2023, DPDP Rules, 2025, and any other applicable data protection regulations.
- Jobseeker Verification: Ensure that all jobseeker resumes submitted are genuine, lawfully authorized for submission, and do not infringe on any intellectual property or third-party rights.
- No Discriminatory Practices: Comply with anti-discrimination laws and avoid posting or engaging in activities that promote discrimination based on race, gender, nationality, disability, age, religion, or any other protected status.
- Privacy Protection: Safeguard the personal information of jobseekers and candidates, and ensure compliance with the DPDP Act, 2023, DPDP Rules, 2025, the IT Act, 2000, and all other applicable privacy laws.
- Account Security: Maintain the confidentiality of your login credentials and immediately notify Techotlist Connects LLP of any unauthorized use of your account at support@techotlist.com.
5. Acceptable Use Policy
Users must use the Platform solely for lawful, good-faith professional activities consistent with this Agreement. The following are expressly prohibited:
- Submitting fictitious, fabricated, or unauthorized candidate profiles or resumes.
- Posting fraudulent, misleading, or non-existent job listings.
- Spamming candidates, recruiters, or other users with unsolicited mass communications.
- Using the Platform to identify candidates or job openings and then deliberately circumventing the Platform to transact directly and avoid Platform fees or obligations (see Section 6).
- Creating multiple accounts to game the Platform's matching, visibility, or ranking features.
- Reverse engineering, scraping, or extracting data from the Platform using automated tools, bots, crawlers, or scripts.
- Uploading malware, viruses, or any harmful or disruptive code to the Platform.
- Impersonating any person, company, or entity.
- Using the Platform for any purpose that violates Indian law, US law, or any applicable international law or regulation.
Violation of this Acceptable Use Policy constitutes a material breach of this Agreement and may result in immediate account termination, legal action, and financial liability to Techotlist Connects LLP.
6. Anti-Circumvention and Non-Solicitation
- Anti-Circumvention: You agree that you will not circumvent, bypass, or undermine the Platform in any way. If you identify a business opportunity through the Platform, you may not pursue or facilitate that opportunity outside the Platform for the purpose of avoiding any fees, obligations, or terms of this Agreement.
- Non-Solicitation: You agree not to use connections, contact information, or data discovered through the Platform to solicit other Users' candidates, clients, or business relationships in a manner that competes with or undermines the Platform's operations.
- Reporting Obligation: If you become aware of circumvention activity by another User, you are encouraged to report it to support@techotlist.com.
- Remedies: Techotlist Connects LLP reserves the right to pursue all available legal and equitable remedies against any User found to have engaged in circumvention, including injunctive relief, damages, and account termination.
7. Platform Use License
- Grant of License: Techotlist Connects LLP grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for lawful business purposes in accordance with this Agreement.
- Prohibited Use: You may not use the Platform to engage in illegal activity, fraud, identity theft, data scraping, reverse engineering, unauthorized automated access, phishing, or any activity that could harm or disrupt the Platform's services or other users.
- No Sublicensing: You may not sublicense, resell, or provide Platform access to any unauthorized third party.
8. Intellectual Property
- Company Ownership: Techotlist Connects LLP retains all rights, title, and interest in the Platform, including all software, technology, algorithms, databases, trademarks, and content. Nothing in this Agreement transfers any intellectual property rights to Users.
- User-Generated Content: By submitting resumes, job posts, hotlists, or any other content, you grant Techotlist Connects LLP a non-exclusive, worldwide, royalty-free license to use, modify, store, distribute, and display your content solely as necessary for the Platform's operations. You represent that you have the right to grant this license.
- Feedback: Any feedback, suggestions, or ideas you provide regarding the Platform may be used by Techotlist Connects LLP without restriction, compensation, or attribution.
- No IP Transfer: Your use of the Platform does not grant you any ownership or license over Techotlist's trademarks, logos, or brand names.
9. Data Privacy, Security, and DPDP Act Compliance
Techotlist Connects LLP is a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Digital Personal Data Protection Rules, 2025 (DPDP Rules).
9.1 Legal Basis and Privacy Notice
- Consent-Based Processing: We collect and process your Personal Data on the basis of your explicit, free, specific, informed, and unconditional consent, as required by the DPDP Act, 2023.
- Privacy Policy: All Personal Data is handled in accordance with our standalone Privacy Policy, which is incorporated into this Agreement by reference.
- Itemized Notice: In accordance with DPDP Rules, 2025, we provide you with an itemized notice specifying: (a) the personal data collected; (b) the specific purposes of processing; (c) mechanisms to withdraw consent; (d) mechanisms to exercise your data rights; and (e) the process for filing complaints with the Data Protection Board of India.
9.2 Data Collected by User Type
- Jobseekers: Email address, phone number, resume content, and any other information you voluntarily submit. Payment information will be collected when payment functionality is launched, processed via a PCI DSS-compliant third-party processor.
- Bench Sales Marketers and Recruiters: Company Email ID only. No additional personal information is collected at registration.
- Bench Sales Candidates: Resumes uploaded by the bench sales recruiter, displayed to recruiters only on consented connected users.
- All Users: Platform usage data, login timestamps, IP addresses, and device information for security and operational purposes.
9.3 Data Usage and Purpose Limitation
- Purpose Limitation: We process your Personal Data solely for the purposes specified in our Privacy Policy and for which you have given consent. We will not use your data for any incompatible purpose without obtaining fresh consent.
- Data Submission Consent: By logging in with a Company Email ID and uploading data, you confirm that you are willingly and lawfully submitting such data, and that it will be accessible by other authorized Users on the Platform.
- Third-Party Access: Techotlist Connects LLP serves as a technology intermediary. While we implement reasonable security measures, we are not liable for any unauthorized access, disclosure, or misuse of data by other Platform users.
9.4 Your Rights as a Data Principal (DPDP Act, 2023)
- Right of Access: Request a summary of the Personal Data we hold about you and the processing activities we undertake.
- Right to Correction: Request correction of inaccurate, incomplete, or outdated Personal Data.
- Right to Erasure: Request deletion of your Personal Data when it is no longer necessary, or upon withdrawal of consent. We will notify you at least 48 hours before completing any scheduled erasure.
- Right to Withdraw Consent: Withdraw consent at any time. Note that withdrawal may result in your inability to continue using the Platform.
- Right to Grievance Redressal: File a complaint or raise a grievance with our designated contact regarding handling of your Personal Data.
- Right to Nominate: Nominate another individual to exercise your data rights in the event of your death or incapacity.
- How to Exercise: Contact us at support@techotlist.com. If unsatisfied with our response, you may file a complaint with the Data Protection Board of India.
9.5 Data Security
- Security Safeguards: We implement industry-standard security measures including encryption, access controls, access logging and monitoring, data backups, and intrusion detection systems.
- Third-Party Processors: All third-party processors are contractually required to implement equivalent security safeguards and may not use your data for any purpose other than providing services to us.
- No Absolute Guarantee: No internet-based system is completely secure. While we take all reasonable steps to protect your data, we cannot guarantee absolute security.
9.6 Data Breach Notification
- Obligation to Report: In the event of a personal data breach, we will promptly notify affected Data Principals in plain language and submit a comprehensive report to the Data Protection Board of India within 72 hours.
- User Responsibility: You must immediately notify us at support@techotlist.com if you suspect any unauthorized access to your account.
9.7 Data Retention and Deletion
- Retention Period: We retain Personal Data only for as long as necessary to fulfil the purposes for which it was collected or as required by applicable law.
- Employment-Change Deletion: As set out in Section 2.3, certain User Data is automatically and permanently deleted upon the deactivation of a User's Company Email ID.
- Post-Account Deletion: Upon deletion of your account, we will delete your Personal Data in accordance with our Privacy Policy, except where retention is required by law.
10. AI Tools and Chat Interface
- AI Usage: Techotlist may use artificial intelligence tools for generating interview questions, categorizing job details, matching candidates, and assisting in data processing. Techotlist Connects LLP is not responsible for the accuracy, completeness, or fitness for purpose of AI-generated content. Users must independently verify all AI-generated content before acting on it.
- AI and Personal Data: To the extent that AI tools process Personal Data, such processing is conducted in accordance with our Privacy Policy and the DPDP Act, 2023.
- Chat Interface: The Platform integrates a chat interface to facilitate communication between Users. Techotlist Connects LLP is not responsible for the content exchanged in chats. Users are solely responsible for their communications.
- Chat Data Deletion: All chat and message history is permanently deleted upon employment change as set out in Section 2.3.
11. Prospects Tab and User Connections
- Prospects Tab: The Prospects tab allows Users to view and connect with other Platform members. By using this feature, you acknowledge that your professional profile may be visible to other authenticated Users.
- Connection Portability: Professional connections are portable and will be retained when a User transitions to a new employer and creates a new account.
- Disputes: Techotlist Connects LLP is not responsible for any disputes, losses, or issues arising from connections or interactions made through the Platform.
12. Compliance with US Work Authorization
- Work Authorization Compliance: Users who post or seek job opportunities for candidates in the United States must ensure full compliance with all US work authorization requirements including H1B, OPT, CPT, GC, EAD, and all other applicable work visa and immigration statuses.
- No Violation of Immigration Laws: You agree not to post, offer, facilitate, or accept any job opportunities that violate US immigration laws or that enable unauthorized employment.
- No Immigration Advice: Techotlist Connects LLP does not provide immigration or legal advice. Users are responsible for seeking qualified professional counsel to ensure compliance with all applicable immigration and labor laws.
13. Payment Terms [Future]
- Subscription and Service Fees: Techotlist Connects LLP may charge fees for certain Platform services. All applicable fees will be separately disclosed on the Platform prior to purchase.
- Subscription Term and Renewal: Subscriptions automatically renew for successive equivalent periods unless cancelled at least 5 days before the renewal date. You will be notified of renewal and any price changes at least 5 days in advance.
- Cancellation: You may cancel your subscription at any time by contacting support@techotlist.com. Cancellation takes effect at the end of the then-current billing period.
- Non-Refundable: All fees paid for Platform services are non-refundable unless explicitly stated otherwise in writing by Techotlist Connects LLP.
- Late Payment: Failure to pay fees when due may result in suspension of access. Access will be restored upon full payment of outstanding amounts.
- Future Payment Features: When payment processing functionality is launched, all payment data will be handled in compliance with PCI DSS v4.0 standards via a certified third-party payment processor. Techotlist Connects LLP will not directly store raw credit card data.
14. Third-Party Services
- Third-Party Integrations: The Platform may integrate with third-party service providers including cloud hosting, payment processors, email delivery services, analytics tools, and AI service providers. Techotlist Connects LLP is not responsible for the performance, availability, security, or data handling practices of these third parties beyond our contractual obligations.
- User Data Passing Through Third Parties: All third-party processors are required to comply with applicable data protection laws and our data processing agreements.
- Links to External Sites: The Platform may contain links to external websites. Techotlist Connects LLP does not endorse and is not responsible for the content, privacy practices, or availability of external sites.
15. Company Representations and Warranties
Techotlist Connects LLP represents and warrants that:
- It has the legal right and authority to operate the Platform and enter into this Agreement.
- It holds all necessary licenses, registrations, and intellectual property rights required to offer the Platform's services.
- It will not knowingly introduce malware, viruses, or harmful code into the Platform.
- It will implement and maintain reasonable technical and organizational security measures to protect User Data.
- It will comply with all applicable Indian laws and regulations in operating the Platform, including the DPDP Act, 2023 and DPDP Rules, 2025.
EXCEPT AS EXPRESSLY STATED IN THIS SECTION, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
16. Disclaimers and Limitations of Liability
- No Employment Guarantee: Techotlist Connects LLP does not guarantee employment for any Jobseeker or fulfillment of any job posting. The Platform acts solely as a marketplace intermediary.
- Platform Availability: We do not guarantee uninterrupted or error-free Platform access. We are not liable for disruptions, downtime, data loss, or issues caused by external factors including internet failures, third-party services, force majeure events, or cyberattacks.
- Limitation of Liability: To the maximum extent permitted by applicable law, Techotlist Connects LLP's aggregate liability to any User shall be limited to the total fees paid by that User in the twelve (12) months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, punitive, or consequential damages.
- AI Content Disclaimer: Techotlist Connects LLP is not liable for any loss or damage arising from reliance on AI-generated content on the Platform.
17. Force Majeure
Techotlist Connects LLP shall not be held liable for any delay or failure to perform its obligations under this Agreement arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, labor disputes, internet or telecommunications failures, pandemics, power outages, or cyberattacks. In such events, our obligations will be suspended for the duration of the force majeure event.
18. Termination
- Termination by Techotlist — Immediate: We may immediately suspend or terminate your access without notice if you: (a) engage in fraudulent, illegal, or harmful activity; (b) violate Section 5 or Section 6; (c) breach data privacy obligations; or (d) misuse other Users' personal data.
- Termination by Techotlist — With Cure Period: For other non-material violations, we will provide written notice and a 7-day period to cure the breach before terminating access.
- Termination by User: You may terminate your account at any time by contacting support@techotlist.com. Fees paid are non-refundable upon voluntary termination.
- Effect of Termination: Upon termination, your license to use the Platform ceases immediately. All associated data will be deleted in accordance with our Privacy Policy and Section 2.3.
- Company Email ID Deactivation: Deactivation or expiration of your Company Email ID is treated as equivalent to termination of your account.
19. Indemnification
You agree to indemnify, defend, and hold harmless Techotlist Connects LLP, its partners, officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of this Agreement or any applicable law; (c) your submission or misrepresentation of data on the Platform; (d) your infringement of any third-party rights; (e) any unauthorized use of your account credentials; (f) your violation of any US immigration or work authorization law; or (g) any circumvention activity as described in Section 6.
20. Publicity and Marketing
- Consent to Reference: By using the Platform, you consent to Techotlist Connects LLP referencing your company name (but not individual names or personal data) in Platform-related marketing materials solely to indicate that your organization uses the Platform. We will not use your company logo without separate written permission.
- Opt-Out: You may opt out of this marketing reference at any time by contacting us at support@techotlist.com.
21. Assignment
- Assignment by Company: Techotlist Connects LLP may freely assign, transfer, or novate this Agreement to any successor entity, affiliate, or acquirer in connection with a merger, acquisition, or sale. Such assignment will be notified to Users via the Platform or email.
- Assignment by User: You may not assign, transfer, or delegate any of your rights or obligations under this Agreement without the prior written consent of Techotlist Connects LLP. Any attempted assignment without such consent is void.
22. Governing Law and Dispute Resolution
- Applicable Law: This Agreement is governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the DPDP Act, 2023, and the DPDP Rules, 2025.
- US Regulatory Compliance: Users engaging in US employment-related activities acknowledge that their conduct on the Platform may also be subject to applicable US federal and state laws.
- Good Faith Resolution: Parties will first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice of the dispute.
- Arbitration: Disputes not resolved through negotiation shall be submitted to binding arbitration under the Indian Arbitration and Conciliation Act, 1996. Proceedings shall be conducted in India in the English language.
- Class Action Waiver: All dispute resolution proceedings shall be conducted on an individual basis only. Class, consolidated, or representative actions are expressly waived.
- Interim Relief: Nothing in this Section prevents either party from seeking urgent injunctive or other interim relief from a competent court of law.
23. Waiver
The failure of Techotlist Connects LLP to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver will only be effective if in writing and signed by an authorized representative of Techotlist Connects LLP.
24. Amendments to the Agreement
Techotlist Connects LLP reserves the right to update, modify, or amend this Agreement at any time. Changes will be communicated via the Platform or by email to the Company Email ID on your account before the changes take effect. Your continued use of the Platform following notification constitutes acceptance of the updated terms. If you do not agree to the amended terms, you must discontinue use and may terminate your account.
25. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of this Agreement shall continue in full force and effect.
26. Entire Agreement
This Agreement, together with the Privacy Policy and any other policies or addenda incorporated herein by reference, constitutes the entire agreement between you and Techotlist Connects LLP with respect to the Platform and supersedes all prior agreements, representations, warranties, and understandings, whether written or oral.

User Acknowledgment
By accessing or using the Techotlist Platform, you acknowledge that you have read, understood, and agree to be legally bound by this User License Agreement (Version 1.0), including the mandatory Company Email ID requirement (Section 2), the data deletion provisions upon change of employment (Section 2.3), the Acceptable Use Policy (Section 5), the Anti-Circumvention provisions (Section 6), the DPDP Act compliance framework (Section 9), and all other terms and conditions herein. You further represent that you have the legal capacity and authority to enter into this Agreement on behalf of yourself and, where applicable, your employing organization.
This Agreement (Version 1.0) has been drafted in accordance with the Indian legal framework, the DPDP Act, 2023, the DPDP Rules, 2025, applicable US work authorization laws, IT staffing industry compliance standards, and the Platform's AI and communication features. Techotlist Connects LLP strongly recommends consultation with qualified legal professionals in both India and the United States before finalizing and publishing this Agreement.
